2.1 LettingsBy.com aims, within all reasonable circumstances, to provide a service enabling private landlords and agents to advertise their properties for rent via the Internet.
2.2 LettingsBy.com charges users a simple one off fee to private landlords upon submission of an advert to the website. No further commissions or charges are incurred once a successful tenant for an individual property is found through the use of LettingsBy.com 'services.

3. LettingsBy.com reserves the right to:
3.1 Limit the provision of the service to any person or geographic area.
3.2 Change the scope of the service.
3.3 Change these terms as we see fit.
3.4 If users disagree with LettingsBy.com scope or its terms and conditions,
(whether the terms apply at the time of first use of the service or as altered subsequently) they should cease to use the website and its services immediately.

4. Payments
4.1 All services that require prepayment by credit card or cheque will only be available once payment has cleared, given access, forwarding of downloaded documents or information services.

5. Refunds
5.1 Refunds will be given at the discretion of the company management. Any issue regarding refunds should be raised in an email and sent to refunds@LettingsBy.com.

6. Your responsibilities:
6.1 Users will be held responsible for ensuring that all information (including all photographs of a property) provided by them is complete, accurate, not misleading in any way, and that by registering, warrants LettingsBy.com and those who visit the website that they have the legal capacity to offer the property for rent.
6.2 Before registering a property to rent with LettingsBy.com, users must check that by doing so, they do not contravene any contract or agreement they have already entered into with a letting agent. If any contravention exists, they must decline from posting any property details on this website.
6.3 Users must not, when using the service, contravene any legal or regulatory requirements imposed by any authority that has the right to regulate their actions in using the website.
6.4 Users must not use the services provided by LettingsBy.com for any of the following; (a) the transmission of any material that is defamatory, offensive or of an abusive, obscene, menacing or inflammatory character; (b) to cause anxiety to, annoy, or inconvenience any other person, business, company or other organisation; (c) to violate or infringe the rights of any person, business, company or other organisation; or (d) to send any message that might otherwise be unlawful.
6.5 Users must immediately inform LettingsBy.com of any claim or action against themselves that result from their use of the service.
6.6 LettingsBy.com accept no liability with respect to any documentation including tenancy agreements and notices. It is your responsibility to have these documents independently checked by a solicitor, or legal advice may be available under the Legal Aid Scheme. The tenant should also be able to obtain information from a Citizens Advice Bureau, a Housing Aid Centre or solicitor.

7. Misuse of LettingsBy.com services:
7.1 any misuse of the service is grounds for intervention by LettingsBy.com. This may include an investigation into the misuse, immediate suspension of the whole service, termination of our agreement with the user, or all of these.
7.2 LettingsBy.com reserves the right to remove any material placed on its servers by users that, within reasonable opinion, we believe violates these terms or is otherwise harmful to our interests or those of any subscribers to our services.
7.3 In the result of any claim made against LettingsBy.com brought about by the usage of its services by any user, the user will be held responsible and deemed liable for any costs incurred by LettingsBy.com on a full indemnity basis in pursuance of a settlement to the claim.
7.4 LettingsBy.com reserves the right to claim damages from a user for any losses that it suffers as a result of a breach of these terms.

8. Termination and suspension of LettingsBy.com services:
8.1 any breach of these terms and conditions may result in an immediate termination to our agreement with any user.
8.2 LettingsBy.com may suspend provision of its services in whole or in part, to any individual user or as a whole, until further notice with immediate effect if:
a) LettingsBy.com has reasonable grounds in its absolute discretion to suspect or have reasonable grounds to suspect that a user may have misused the service;
b) LettingsBy.com are obliged to comply with an order, instruction or request of Government, an emergency services organisation, or other administrative, competent authority; or;
c) LettingsBy.com is required to carry out work relating to upgrading or maintaining of its services or network.

9. LettingsBy.com obligations:
9.1 LettingsBy.com shall use reasonable skill and care to ensure that its services are available to its users on a continuous basis. Due to the nature of computers and the Internet, LettingsBy.com cannot guarantee that its services will be uninterrupted or be provided at a particular speed.
9.2 LettingsBy.com cannot be held responsible for the following;
a) any loss of data or information;
b) loss of opportunity to rent, let or view a property;
c) loss of profit or extra expense resulting from fluctuations in house prices;
d) any direct or indirect losses whatsoever or howsoever arising;
e) any loss that is caused by a users' own error or omission.
9.3 LettingsBy.com has taken great efforts to choose it's associated business partners. LettingsBy.com understands that due to this association our chosen business partners' actions can reflect on the perception of our company so far as our users are concerned. LettingsBy.com values its user's custom and wishes in no way to harm this relationship. LettingsBy.com cannot accept liability for the quality of the goods or services provided to users by our associated business partners but would like to hear from any unhappy client immediately so we may strive to improve our service.

10. Copyright and intellectual property rights:
10.1 All written, photographic, design and audio content of this website is the intellectual property of LettingsBy.com or the company that has licensed LettingsBy.com use of it and is protected as such. No material may be reproduced without LettingsBy.com' written permission.
10.2 LettingsBy.com reserves the right to re-publish any material contributed by the users of its website. By agreeing to these terms, users expressly grant LettingsBy.com the right to reproduce or re-publish anywhere in the world any material placed on the website, without LettingsBy.com having responsibility to pay any royalties directly or indirectly to the owner of the intellectual property of that material.

14. General terms and conditions:
14.1 Users may not assign, sub-license or otherwise transfer any of their rights under these terms although LettingsBy.com may do so.

LettingsBy.com agrees that the courts of England have exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
